The Edo State High Court, in a landmark decision delivered in favor of our client by His Lordship, Hon. Justice J.O. Okeaya-Inneh, has ruled against the practice of placing a lien on a customer’s account without a valid court order.
In Suit No. B/234os/2021, the court held that Fidelity Bank PLC has no right whatsoever to place a lien on a customer’s account solely on the instruction of the Economic and Financial Crimes Commission (EFCC) without securing a valid court order.
This judgment reaffirms the legal protection of customer rights in banking transactions and emphasizes the necessity for judicial oversight before such actions can be taken. By ensuring that banks adhere strictly to the rule of law, this ruling serves as a precedent to safeguard customers from arbitrary restrictions on their accounts.
